This document is a legally binding contract between our services and you, for the use of the applications, software, products and services provided by this website (collectively, the “Service”) and as such, we have tried to make it as clear as possible. In addition to the full legal terms and text, we have provided short non-binding summaries with each clause. These summaries do not aim to replace or misrepresent the full text.

I.    i. “AGREEMENT” refers, collectively, to all the terms, conditions, notices contained or referenced in this document (the “Terms of Service,”) and all other operating rules, policies, including Privacy Policy and Intellectual Property Policy, and procedures that we may publish from time to time on the Website including but not limited to Shipping, Payments, and Returns.

I.    ii. “CONTENT” refers to content featured or displayed through the Website, including without limitation text, data, articles, images, photographs, graphics, software, applications, designs, features, and other materials that are available on the Website or otherwise available through the Service.
  • I. I.    iii. “CUSTOMERS” refers to individuals or entities that purchase Your Products through a Sales Channel.
  • I. I.    iv. “ORDERS” refer to Your Products once they have been purchased by You or Your customers.
  • I. I.    v. “PRODUCED ORDERS” refer to Orders that have been completed and shipped.
  • I. I.    vi. “PRODUCTS” refers to all products offered by different Providers on our Website including, but not limited to clothing, accessories, home decor, kitchenware, footwear and stationary.
  • I. I.    vii. “PROVIDERS” refers to the organizations and companies partners with in the scope of its Service to offer Products to You.
  • I. I.    viii. “SALES CHANNELS” or “Stores” refer to the other websites and platforms use to sell Your Products.
  • I. I.    ix. “US” and “WE” refers to this website and services, as well as our affiliates, directors, subsidiaries, contractors, licensors, officers, agents, and employees.
  • I. I.    x. “USER”, “YOU”, “YOUR” refers to the individual person, company, or organization that has visited or is using the Website or Service.
  • I. I.    xi. “WEBSITE” refers to this website, and all content, services and products provided through the Website. It also includes the subdomains, and the use of future and current plugins. Occasionally, plugin pages and websites may provide additional or different terms of service.

If any provision of these Terms of Service are held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.


II. II.    WHEN DO THESE TERMS APPLY?

By using the Service, You acknowledge that You accept and agree to be bound by these Terms of Service. If You do not agree to these Terms of Service, You may not access the Service.


II. III.    CAN THESE TERMS BE MODIFIED?

We reserves the right to revise the Terms of Service from time to time and the most current version will always be posted on our Website. Your use of the Service following the effective date of any modifications to the Terms of Service will constitute your acceptance of such modification. If You do not agree to the new Terms of Service, You should stop using the Service.

While we may give work with third-party services (“Third Party Sites”). We does not endorse any of these Third Party Sites and does not control them in any manner. These Third Party Sites may be governed by their own terms of service and policies. We are not liable or responsible for the accuracy of such services or their content.

Due to the nature of the Internet, we cannot guarantee uninterrupted access and availability of the Service. We reserve the right to restrict the availability of our Service or certain features if necessary in view of capacity limits or the integrity of our servers. We also reserve the right to restrict access when performing maintenance measures to ensure the proper working and functioning of the Service. We can improve or modify the Service and may introduce new offerings from time to time.


II. IV.    WHO CAN ACCESS AND USE THE SERVICE?

  • II. IV.    i. By accessing and using our Service, you represent and warrant that you are on legal age and you have the legal capacity and authority to enter into a contract. You are authorized to grant all permissions and licenses provided in this Terms of Service and bind the entity to these Terms of Service, and that you agree to these Terms of Service on the entity's behalf.
  • II. IV.    ii. The access to or use of certain areas and features of the Service may be subject to separate policies, standards or guidelines, or may require that you accept additional terms and conditions.

II. V.    HOW DO PAYMENTS WORK ON THIS WEBSITE?

  • II. V.    i. To fulfill any Customer Orders, You must pay for the Order in advance. The price You pay will be the price of the Product plus shipping and taxes (if applicable). Orders will not be processed until payment has been received. In order to process payments, You need to either have a Credit or Debit card on file or connect to your PayPal account. Our service charges Users when Orders are sent to production.
  • II. V.    ii. We may issue a coupon. A coupon is virtual money that can be used for paying for manual and sample orders. You may use a coupon only for a single order. Multiple coupons cannot be combined. Each coupon's value is divided according to the total line items in the order. It cannot be converted to cash or withdrawn.
  • II. V.    iii. If you have an issue with your order, contact us using the chat icon at the store before disputing your claim with your credit card company. If you have filed a dispute with your credit card company, we will not be able to issue you any refunds or replacements until the dispute is resolved or cancelled. 
  • II. V.    iv. European Union (EU) regulations require the service to collect Value Added Tax (“VAT”) on all orders produced and shipped within the EU. Users with businesses registered with the EU may apply for a VAT Exemption if the Users have a valid VAT number. If you qualify for a VAT exemption.



III. SHIPPING & REFUND POLICY

III. I.    WHAT ARE THE SERVICE PRODUCTION TIMES LIKE?

The order production time depends on several factors, such as time of the year, product stock status, and order size. Almost all orders are shipped within 2-7 business days from the order submission date. 

That being said, it is important to note that the exact fulfillment timeframe can differ from order to order. Occasionally, the order fulfillment may take longer than initially expected. This may be caused by one of the following:
  • The garment is out of stock and needs to be ordered from the supplier (if the delay is just a few days, the print providers do not necessarily inform us).
  • The product did not pass the post-production quality check and needs to be reprinted to ensure a high-quality standard.
  • The order contains 12 or more items.

However, if your order hasn’t been updated or shipped within 7 business days, please get in touch with our Support team for a status update.


III. II.    HOW DOES THE SERVICE HANDLE REFUNDS AND RETURNS?

All products are unique and produced only once ordered. This also means that returns and exchanges are not supported if your customer ordered the wrong size, color, or simply changed their mind.

However, in case of a damaged product or a manufacturing error, the service offers a free replacement or a refund if you contact us within 30 days of product delivery. Please get in touch with our team using the chat icon at the store and provide a clear photo showing the issue. If there’s an issue affecting multiple products, an additional photos (or videos) of all affected items visible in one frame will be required for confirmation purposes.

Note. If the order shipping details were incorrect, or if the customer ordered the wrong size or color, the service will not be held responsible and will not offer replacements or refunds. You are responsible for capturing the correct information from your customers.

III. III.    HOW DOES THE SERVICE HANDLE ORDER RELATED ISSUES?

Summary: If you have an issue with your order, contact us directly using the chat icon at the store within 30 days of product delivery and provide a detailed description of your issue, accompanied by relevant photo or video evidence that support your case. After investigation, we will determine if you are eligible to receive a replacement at no cost to you. Some issues do not qualify for replacement, they are outlined below.

  • III. III.    i. We do not hold any inventory and ds not perform any of the printing itself. However, if your order has issues, steps for resolution are outlined below.
  • III. III.    ii. We will handle all conflict resolution on your behalf. Users agree to contact our Support using the chat icon at the store for all conflict resolution. If the Produced Order does not meet User or Customer expectations, Users must first contact us within 30 days of product delivery and will not contact the Print Providers. In order to best resolve the matter, the User should provide all relevant materials for the service to investigate the issue, including a description of the Produced Order, the issue, and quantity of Products affected. If a User contacts the Provider directly, the User risks a ban at our service sole discretion.
  • III. III.    iii. Products are unique and produced to order, therefore, they are non-refundable. Once an Order has been sent to production it is sent to the Provider and the User can no longer edit the details of the Order or cancel it. If the shipment details are incorrect, or the Customer ordered the wrong size or color, we are not responsible and will not offer replacements or refunds. The User is responsible for relaying the correct information. 
  • III. III.    iv. The Production times listed on the Website are estimated average times and are in no way guaranteed. If Your Order seems to be taking an unusually long time to be produced or delivered, please contact our Support team using the chat icon at the store. If the Produced Order is lost during Shipment, the service will investigate and may provide replacements when appropriate.
  • III. III.    v. After investigating Your issue, if the service team determines that your Product is faulty, Your Orders will be submitted for either reprint or replacement. Refunds are only provided if a subsequent reprint or replacement is also found to be faulty by our the service Support team. The service does not give refunds for orders that have been shipped without tracking until they are verified to be lost.
  • III. III.    vi. If an order is returned to the service due to an incorrect address, the User will be contacted by to arrange a reshipment. The User will be liable for the reshipment costs once an updated address is provided and confirmed. Otherwise, packages will be donated after one week if the service is not provided with a valid address for the reshipment. Reshipment costs include the original shipping cost of the product and a service fee of $4. The service fee covers any Charge On Delivery (C.O.D) fees that we get charged by the fulfillment operator and handling fees.
If an order has not been delivered in 30 calendar days (for domestic US or regional EU orders) or in 45 calendar days (for international orders), you have to contact us ASAP using the chat icon at the store in 1 week in order to be eligible for a reprint/refund.


IV. LEGAL DISCLAIMER

IV. I. LIMITATION OF LIABILITY

Summary: We are not responsible for any losses you incur as a result of using our service. We are not responsible if you break the law or breach this agreement and are sued as a result. Please read this section carefully; it limits our obligation and responsibilities to you.

Limitation of Liability. IN NO EVENT SHALL THIS SERVICE, ITS OFFICER, DIRECTORS, AGENTS, AFFILIATES, EMPLOYEES, ADVERTISES, OR PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), EQUITY OR OTHERWISE, OR FOR DAMAGES IN THE AGGREGATE EXCEEDING THE AMOUNT OF THE FEES PAID AND PAYABLE BY YOU TO OUR SERVICE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify and hold our services and, its parent, subsidiaries, affiliates, partners, and Providers, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service, or your violation of any law or the rights of a third party.

Warranty Disclaimer. This service controls and operates from various locations and makes no representation that the Service is appropriate or available for use in all locations. Services may not be available in Your location or may vary across locations. THE SERVICE AND CONTENT ARE PROVIDED “AS IS”, “AS AVAILABLE” AND IS PROVIDED WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED, SAVE TO THE EXTENT REQUIRED BY LAW. THIS SERVICE, AND ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS, PARTNERS AND PROVIDERS DO NOT WARRANT THAT: (A) THE SERVICE WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK. SOME STATES / COUNTRIES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.


IV. II. WHAT IF I HAVE LEGAL ISSUES WITH THIS SERVICE?

Summary: If you have legal issues with the service, you agree to talk to us first, using the chat icon at the store, and if we can't resolve the situation together, we will follow professional procedures for arbitration. If the issue isn't arbitrable, all legal issues will be handled in the State of Delaware.

  • IV. II.    i. If a dispute arises from or relates to these Terms of Service, You agree to first contact our Support, using the chat icon at the store, to attempt to resolve the issue. If the dispute cannot be settled through direct discussions, the parties agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. The parties further agree that any unresolved controversy or claim arising out of or relating to the Terms of Service shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

II.    ii. To the extent any claim, dispute or controversy regarding this service or our Service isn't arbitrable under applicable laws or otherwise, You and this service both agree that any claim or dispute regarding the service will be resolved exclusively in accordance with this Terms of Service.
  • IV. II.    iii. These Terms of Service shall be governed by the laws of the State of Delaware, without respect to its conflict of laws principles. You agree to submit to the personal jurisdiction of the United States District Court for the District of Delaware, for any actions not subject to Arbitration as outlined in Clause N.1 herein.
